Intan is a Partner  in Christopher & Lee Ong’s Technology, Media & Telecommunications, and Data Privacy & Protection Practice Group.

She has been practising exclusively in the areas of technology and telecommunications law and data protection since 1999.

Intan advises clients on matters relating to information technology ("IT") contracts, electronic commerce, online financial services, outsourcing and digital media as well as personal data protection. She specialises in structuring, drafting and negotiating information technology contracts and electronic as well as mobile commerce services.

Intan has acted on numerous public and private sector IT turnkey contracts, large financial sector outsourcing projects, and played a key role in the development of several first of its kind electronic financial services deployed in Malaysia. Other than this, she also advises clients on the registration, protection and commercialisation of their intellectual property both locally as well as outside Malaysia.

Intan’s clients include major public listed corporations, multinational companies, financial institutions, public sector agencies, information technology vendors, telecommunications service providers and industry associations.

Intan has been consecutively ranked as a Tier 1 leading individual for TMT by The Legal 500 Asia Pacific.

Experience
Technology
  • Advised the chosen concessionaire of the insurance industry on the structuring and setting up Malaysia’s nationwide on-line automotive insurance claims system.
  • Advised a leading Malaysian universal bank in connection to their Regional Human Resource Information System which involved the regularisation of Agreements with a leading global human capital management technology provider pursuant to the then Outsourcing Exposure Draft issued by the Central Bank of Malaysia. The project involved the transformation of the bank’s human resources IT infrastructure to a cloud-based system, with an emphasis on regulatory compliance.
  • Acted for several Malaysian financial services groups in negotiating their respective contracts for the replacement of their core banking systems, and the relevant licensing, support and maintenance agreements.
  • Advised and acted for several Malaysian financial services groups in negotiating a variety of outsourcing arrangements, including but not limited to the outsourcing of IT infrastructure, application management, security services, self-service terminals and the transfer of the relevant staff.
  • Advised several Malaysian hospitals on the licensing and implementation of total hospital information management systems.
  • Advised and acted for a major Malaysian conglomerate active in the development and operation of expressways, in property development, engineering and construction works, etc. on the preparation of the relevant tender documents and agreements, inclusive of negotiation of the same, in relation to their IT Transformation program.
  • Advised a national security agency on the preparation of standard documentation to assist in their tender and contracting processes, as well as negotiating a variety of contracts for the said client.
  • Advised the Malaysian Intellectual Property Office ("MyIPO") in the drafting of various agreements required for setting up an online intellectual property marketplace for the listing, valuation and trading of intellectual property.
  • Acted for a Malaysian financial services group in revamping all template agreements for the procurement of various  technology and non-technology related services such as software development, licensing, support and maintenance agreements, cloud subscription agreements, consultancy agreements, etc.  in order to streamline the same with all applicable internal procurement processes and compliance requirements.
  • Acted for a Malaysian reinsurance company to draft, review and amend all applicable documents and agreements pertaining to the development and deployment of a core reinsurance system  and provided our advice on all applicable compliance requirements up to the finalisation and completion of the documents and agreements.
  • Appointed by one of the top three largest banks in Malaysia to act as its external legal counsel for the development and regional implementation of its newly upgraded core online banking platform which replaces the existing platform to feature better user experience across multiple business segments and user personas.
  • Advised the sole appointed administrator of the deposit insurance system in Malaysia on all aspects and legal considerations pertaining to the subscription and use of cloud services and potential contractual implications which could arise from the subscription and procurement of cloud services.
  • Appointed by a leading private company in a sector regulated by the Ministry of Finance to advise on the potential legal exposure for past usage of an open-source software without proper licensing.
  • Acted for a Malaysian financial services group in revamping all template agreements for the procurement of various  technology and non-technology related services such as software development, licensing, support and maintenance agreements, cloud subscription agreements, consultancy agreements, etc.in order to streamline the same with all applicable internal procurement processes and compliance requirements.
  • Appointed by one of Malaysia’s biggest online retailers of household products to draft, review, negotiate, and finalise the agreement between the client and the selected third-party vendor, as well as to providing the client with advice in relation to a multitude of issues arising from the retail industry.
  • Acted for a Malaysian reinsurance company to draft, review and amend all applicable documents and agreements pertaining to the development and deployment of a core reinsurance system  and provided our advice on all applicable compliance requirements up to the finalisation and completion of the documents and agreements.
  • Advised a registered Initial Exchange Offering ("IEO") operator with the Securities Commission on legal issues, and agreement drafting and finalisation between the Client and the third-party vendor in relation to the development, purchase, and maintenance of a multi asset digital fundraising, investment, and custodian platform, using blockchains and smart contracts as the underlying technology of its IEO offering / service.
Telecommunications
  • Appointed by one of the pioneer mobile operators in Malaysia to advise them in relation to a spectrum sharing arrangement made pursuant to a Master Collaboration Agreement between the client and its affiliate.
  • Acted for a consortium of companies  on the implementation of Mobile Number Portability in Malaysia and negotiated the various agreements between the Malaysian Communications and Multimedia Commission, mobile operators and the consortium partners.
  • Advised several telecommunications companies on the preparation of their terms and conditions for specific services vis-à-vis their clientele.
  • Advised a publicly listed telecommunications company in relation to an agreement for the provision of a national emergency telecommunications service pursuant to the Malaysian Communications and Multimedia Act 1998.
  • Advised a SPV in the telecommunications industry owned by the Malaysian government, on the deployment of In Building Solutions ("IBS") in approximately 250 buildings/sites approved by the Malaysian Communications and Multimedia Commission ("MCMC") in connection with the nationwide 5G rollout in Malaysia.
  • Prepared and advised on “Build, Operate and Transfer” contracts for the procurement or development and implementation of large-scale IT systems and solutions for a multinational telecommunications company, with presence in many countries throughout Asia.
Data Privacy & Protection
  • Advised a broad range of institutional clientele on compliance with the Malaysian Personal Data Protection Act 2010 prior to its enactment, including conducting audits of their personal data collection practices, making recommendations for compliance, amending their relevant agreements, drawing up relevant policies and procedures.
  • Advised various multi-nationals on specific issues privacy, e.g., transfer of personal data abroad, privacy notices for employees and agreements with data processors.
